These Terms & Conditions govern your use of this website and any purchase you make from Jonathan Smithies (“we”, “us”, “our”). By placing an order, you agree to these terms. Please read them carefully before purchasing.

1. About Us

Jonathan Smithies is a sole trader based in the United Kingdom. We sell wildlife photography prints, greeting cards, and handcrafted woodwork items. If you have any questions, please contact us.

2. Ordering

By placing an order, you are making an offer to purchase. We reserve the right to decline any order. A contract is formed only when you receive an order confirmation email from us.

All prices are displayed in pounds sterling (GBP) and are inclusive of any applicable taxes. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

We sell within the United Kingdom only. We are unable to fulfil orders to addresses outside the UK.

3. Payment

Payment is taken at the time of ordering via Stripe. We accept major debit and credit cards. Card details are processed securely by Stripe and are never stored on our servers.

4. Delivery

We aim to dispatch orders within 3–5 working days. Delivery times thereafter depend on Royal Mail and are typically 2–3 working days for standard items.

Some framed, mounted, or large woodwork items require collection rather than delivery. This will be clearly indicated on the product page. We will contact you by email to arrange a convenient collection time and location.

Delivery charges are displayed at checkout before you complete your order. We are not responsible for delays caused by the postal service or events outside our control.

5. Returns and Refunds

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason, unless the goods are exempt (see below).

To cancel, please contact us within 14 days of receiving your order. You must return the item(s) to us within 14 days of notifying us. Return postage costs are your responsibility unless the item is faulty or incorrectly described.

Items must be returned unused, in their original condition and packaging. Once we receive the return, we will issue a full refund to your original payment method within 14 days.

Exemptions from the right to cancel:

Prints and framed prints produced to your chosen specification (size, finish, and frame) are made to order and are exempt from the 14-day cancellation right under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013. This does not affect your statutory rights if items are faulty.

Faulty or damaged items: If your order arrives damaged or faulty, please contact us within 48 hours of receipt with photographs. We will arrange a replacement or full refund at no cost to you, including return postage.

6. Woodwork Items

All woodwork items are handcrafted and may have minor natural variations in wood grain, colour, and finish. These are characteristics of handmade products and do not constitute defects. Product descriptions and dimensions are as accurate as possible, but slight variations may occur.

7. Intellectual Property

All photographs, images, and content on this website are the exclusive property of Jonathan Smithies and are protected by copyright. Purchasing a print grants you a personal, non-commercial licence to display it in your home. You may not reproduce, distribute, or use any images for commercial purposes without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, our liability to you in connection with any order is limited to the value of that order. We are not liable for any indirect or consequential losses. Nothing in these terms limits our liability for death, personal injury, or fraud.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. The date at the top of the page reflects when they were last revised. Orders placed before any update are governed by the terms in effect at the time of ordering.
